Putting the right terms and conditions in a teaming agreement is the key to its success.
What are the right terms?
The agreement should include:
1. A clear statement that the contract will be awarded to a team member if the prime is awarded a contract.
2. A copy of the terms and conditions and other documents that will be part of the subcontract.
3. A copy of the statement of work and price to be paid.
Without these provisions in the teaming agreement, the lead team member has no obligation to issue an award to the lower tier team member or to issue an award with a set price and statement of work.
Without these provisions, the lower tier team member puts in all the work for their portion of the proposal, without any guarantee they will be awarded the work or if awarded the work, whether they will be awarded a contract with the terms and conditions they expected.
